Customer's photos, artwork, audio
tapes, records, or other related materials will be handled with great care while in our
possession. In the unlikely event of damages, BluEarthArts will be liable only for the
cost of replacement media.
SHIPPING:
For the safe shipment of one-of-a-kind photos, audio, and other artwork, we recommend you
use a tracking service, whether by FedEx, UPS, or the USPS. BluEarthArts can not
assume any responsibility for loss or damage in shipping.
COPYRIGHTED WORKS:
All images on these pages, except where noted, are the property of BluEarthArts and are
protected by copyright. Any use of these images without prior written consent from
BluEarthArts is a violation of US copyright law.
MP3s available on the
bluesjam webpages are provided primarily for the musicians participating in the jam
sessions, but can be freely downloaded by anyone interested in these live recordings (some
are actually quite good).
For customer orders: You can legally convert even your
commercially-made tapes and records to a digital format like MP3 or CD for your personal
use.
Other artwork & photos
Customer represents and warrants that by requesting BluEarthArts to reproduce any
copyrighted work, customer either has:
a) Obtained permission from
the copyright owner to reproduce distribute, display or in any way use such copyrighted
work, or
b) Will use the
reproductions prepared by BluEarth Arts solely for teaching, research, scholarship or for
criticism , comment or news reporting and will not sell the reproductions or use the
reproductions in any manner which is to the direct financial benefit of the customer and
the financial detriment of the copyright owner. Customer agrees to hold harmless and
indemnify BluEarth Arts for all expenses, attorney's fees, or judgments resulting from any
claim or lawsuit against BluEarth Arts for copyright infringement or any other claim or
lawsuit against BluEarth Arts arising out of any alleged claim for invasion of privacy or
defamation, regarding customer's order(s).
Our Unique CDs
BluEarthArts will no longer accept returns on CDs unless the CD is defective. For
purchasers of the Meet Tango CD, take special note: The CD does not contain continuous barking and is not
intended to be used for harassment purposes.
